Did not give any source of identification in the contents of FIR, therefore, chances of petitioner’s false incriminating with due deliberation and consultation cannot be ruled out.

The occurrence allegedly took place on 27.4.2015 at 11.00 P.M. whereas the matter was reported to the police on 09.5.2015 at 10.30 A.M. with an unexplained delay of 12 days for which proper explanation has not been furnished by the complainant. It is also noticed that it was a night time occurrence but the complainant did not give any source of identification in the contents of FIR, therefore, chances of petitioner’s false incriminating with due deliberation and consultation cannot be ruled out. Reliance be placed on Nadeem alias Nanha alias Billa Sher v. The State (2010 SCMR 949), Muhammad Rafique and others v. The State and others (2010 SCMR 385), Ali Gul v. The State (2003 SCMR 201) and Hadayatullah v. Abdul Hameed and another (1984 SCMR 119).
