اسلام آباد ہائی کورٹ نے وزیراعظم عمران خان کو خفیہ دستاویز پبلک کرنے سے روک دیا

 شہری نعیم نے عمران خان کے خلاف دائر درخواست میں استدعا کی تھی کہ عدالت وزیر اعظم کو آفیشل سیکریٹ ایکٹ 1923 کے تحت سیکریٹ دستاویز یا اس کا متن جاری کرنے سے روکے۔

درخواست میں وزیراعظم عمران خان، سیکرٹری قانون اور سیکریٹری خارجہ کو فریق بنایا گیا اور لکھا گیا تھا کہ وزیر اعظم عمران خان نے کہا کہ وہ خفیہ دستاویز ریلیز کریں گے، 27 مارچ کو خفیہ دستاویز کی بنا پر وزیر اعظم نے کہا مبینہ طور پر حکومت کے خلاف غیر ملکی سازش کی گئی، اُن کا بیان آفیشل سیکریٹ ایکٹ کی سیکشن 5 کی خلاف ورزی ہے۔

درخواست پر سماعت مکمل ہونے کے بعد چیف جسٹس اسلام آباد ہائی کورٹ نے تحریری حکم نامہ جاری کیا، جس میں وزیراعظم کو سیکریٹ دستاویز پبلک کرنے سے روکتے ہوئے کہا گیا ہے کہ وزیراعظم کو حلف کی خلاف ورزی کرتے ہوئے کوئی بھی خفیہ معلومات پبلک کرنے کی اجازت نہیں ہے۔

اسلام آباد ہائی کورٹ کی جانب سے جاری تحریری حکم نامے میں لکھا گیا ہے کہ عدالت امید رکھتی ہے وزیر اعظم آفیشل سیکریٹ ایکٹ کی خلاف ورزی نہیں کریں گے، خط کی تشہیر سے روکنے والی استدعا پر روکنے کا حکم وزیراعظم پر اعتبار نہ کرنے جیسا ہوگا۔

It is noted that the Prime Minister of Pakistan represents the people of Pakistan and he was administered the oath under Article 91(5) of the Constitution.

The worthy Prime Minister is an elected leader of the treasury benches. The Court is confident that as an elected Prime Minister he would not disclose any information or act in breach of section 5 of the Official Secrets Act, 1923 nor the oath taken by him under the Constitution. Any decision taken by the worthy Prime Minister has to be in consonance with his obligations under the Official Secrets Act, 1923 and in letter and spirit of the oath of the office. The Court has trust and confidence that the worthy Prime Minister of Pakistan would not reveal any information which may be prejudicial to the national interest and national integrity of Pakistan nor that he would act in any manner that would have the effect of violating his oath.

The petition stands disposed-of in the above terms because passing a restraining order would unjustifiably reflect lack of confidence in an elected Prime Minister.
