دفعہ 22-اے اور بی- ضابطہ فوجداری کی دفعہ 22-اے اور بی کے تحت درخواستوں کا فیصلہ میکانکی انداز میں نہیں کیا جائے گا، بلکہ تمام متعلقہ عوامل کو مدنظر رکھا جانا چاہیے--بشمول فریقین کے مابین تعلقات، فریقین کے مابین لین دین، ماضی کی دشمنی، تنازعہ کی نوعیت بشمول کسی دیوانی یا فوجداری کارروائی کی زیر التواء ہونا اور ایسی درخواستیں دائر کرنے کے ممکنہ پوشیدہ محرکات--دوسری طرف، ضابطہ فوجداری کی دفعہ 561-اے کے تحت ہائی کورٹ کے موروثی اختیارات کا مقصد قانونی عمل کے غلط استعمال کو روکنا اور انصاف کو یقینی بنانا ہے۔
----Ss. 22-A & B--The applications u/S. 22-A & B, Cr.P.C. shall not be decided in mechanical manner, but all relevant factors must be taken into consideration--including inter alia, relationship between parties, transaction between parties, past animosity, nature of dispute including pendency of any civil or criminal proceedings and possible ulterior motives for filing such applications--On other hand, inherent powers of High Court under section 561-A, Cr.P.C. are intended to prevent abuse of process and to seeup ends of justice. دفعہ 22-اے اور بی-- زیرِ نظر معاملے میں، دفعہ 22-اے اور بی ضابطہ فوجداری کے تحت کارروائی کا آغاز بظاہر غلط نیت پر مبنی تھا اور اس لیے انصاف کے تقاضوں کو پورا کرنے کے لیے، سپریم کورٹ کی جانب سے مذکورہ بالا مقدمات میں دی گئی ہدایات کے مطابق، ایسی فضول اور پریشان کن کارروائیوں کی حوصلہ شکنی کی جانی چاہیے۔ سابقہ آفیشیو جسٹس آف پیس کا حکم معقول اور قانون کے مطابق معلوم ہوتا ہے اور اس میں تمام تر حالات و واقعات کو مدنظر رکھا گیا ہے۔ لہذا، مذکورہ بالا درخواست میں کوئی وزن نہیں ہے، اس لیے اسے مسترد کیا جاتا ہے۔
----Ss. 22-A & B--In present case, initiation c proceedings under Section 22-A & B Cr.P.C. was apparently under ill motives and therefore in order to secure ends of justice, such frivolous and vexatious proceedings, as directed by Supreme Court in cases referred ibid, an liable to be discouraged The order passed by Ex-Officio Justice of Peace appears to be well reasoned and within parameters of law and all surrounding circumstances have been considered therein--In view of above application, being devoid of merits, is dismissed.

Order
1. This is an Application challenging the Order passed by the Ex-Officio Justice of Peace, thereby rejecting Applicant’s Application u/S. 22-A & B, Cr.P.C. for lodging FIR against the private Respondent. Learned APG and learned Counsel for Respondent No. 4 raise objection to the instant application on multiple grounds.

In view of the growing tendency of filing frivolous and vexatious applications, the principles settled in the cases reported as 2024 SCMR 985, 2021 SCMR 468, 2020 SCMR 2037, PLD 2005 Lahore 470 and 1991 P.Cr. LJ 1125, are that the applications u/S. 22-A & B, Cr.P.C. shall not be decided in a mechanical manner, but all relevant factors must be taken into consideration including inter alia, the relationship between the parties, the transaction between the parties, the past animosity, the nature of the dispute including pendency of any civil or criminal proceedings and possible ulterior motives for filing such applications. On the other hand, the inherent powers of the High Court under section 561-A, Cr.P.C. are intended to prevent abuse of the process and to (sic) the ends of justice.

While carefully applying the above principles to the facts of the present case and after going through the record with the assistance of the learned APG, it appears that the subject cheque was issued by the Applicant which was presented and dishonored and which holds statutory presumption in its favour, being a negotiable instrument, based whereon the Ex-Officio Justice of Peace rightly issued directions for registration of FIR. In the present case, initiation of proceedings under Section 22-A & B Cr.P.C. was apparently under ill motives and therefore in order to secure the ends of justice, such frivolous and vexatious proceedings, as directed by the Supreme Court in the cases referred ibid, and liable to be discouraged. The order passed by the Ex-Officio Justice of Peace appears to be well reasoned and within the parameters of law and all surrounding circumstances have been considered therein. In view of the above the application, being devoid of merits, is dismissed. These are the reasons of short Order dated 14.02.2025.
