- قبل از گرفتاری ضمانت ، کی منظوری --- شکایت کنندہ کی گردن کے پچھلے حصے پر حملہ اور سوٹا دھکا لگانے کا الزام-اگرچہ درخواست گزار کو ایف آئی آر میں مخصوص کردار کے ساتھ نامزد کیا گیا ہے) شکایت کنندہ کی دائیں آنکھ کے نیچے اور گردن کے پچھلے حصے پر چوٹ پہنچانے کا کردار لیکن حقیقت یہ ہے کہ مذکورہ چوٹوں کو دفعہ 337-A (i) اور L (ii) PPC کے تحت قرار دیا گیا ہے ، جو دو طرفہ نوعیت کے ہیں - ایف آئی آر کے بیان سے یہ بھی ظاہر ہوتا ہے کہ درخواست گزار کے خلاف دفعہ 367 ، پی پی سی کے تحت پہلی نظر میں جرم نہیں بنایا گیا ہے ۔ فریقین کے درمیان سابقہ دشمنی کی موجودگی میں ، درخواست گزار کے جھوٹے مضمرات کے امکانات کو مسترد نہیں کیا جا سکتا-درخواست گزار تحقیقات میں شامل ہو گیا ہے - قبل از گرفتاری ضمانت ایک غیر معمولی راحت ہے جو صرف غیر معمولی حالات میں دی جاتی ہے تاکہ بے گناہ افراد کو قانون کے غلط استعمال کے ذریعے ظلم و ستم سے بچایا جا سکے ۔ ضمانت قبول کرلی گئی ۔

Through this petition under Section 498, Cr.P.C. Nouman, petitioner seeks pre-arrest bail in case FIR No. 114/2016, dated 23.4.2016, registered with the Police Station Miana Gondal, in respect of offences under Sections 367, 341, 109, 34 PPC.

As per FIR lodged by Ihsan Ullah on 23.4.2016, it is alleged that in the night between 22/23.4.2016, at about 1.30 A.M. the petitioner along with his co-accused tried to abduct the petitioner and during the scuffle the petitioner inflicted a sota blow on the back of complainant’s neck. The petitioner also caused an injury below the right eye of complainant.

After careful consideration of arguments advanced by learned counsel for the parties and record, I found that although the petitioner is nominated in the FIR with specific role of causing injuries on below the right eye and back of neck of complainant but the fact remains that the said injuries have been declared falling under Sections 337-A(i) and L(ii), PPC, which are bialable in nature.
5. Besides above, it is noticed that co-accused Wazir Ahmed has been allowed bail by the learned Additional Sessions Judge, Malakwal, vide order dated 26.5.2016. The narration of FIR also reflected that prima facie offence under Section 367, PPC is not made out against the petitioner.
6. In the attending circumstances, prima facie the prosecution is not equipped with the sufficient incriminating material, which connects the petitioner with the commission of alleged offence. Furthermore, in presence of previous animosity between the parties, chances of petitioner’s false implication cannot be ruled out. The petitioner has joined the investigation.
7. Pre-arrest bail is an extra ordinary relief to be granted only in extraordinary situations to protect innocent persons against victimization through abuse of law for ulterior motive. Guidance is sought from Rana Muhammad Arshad v. Muhammad Rafique and another (PLD 2009 Supreme Court D” 427).
8. For the above reasons, this petition is accepted and ad-interim pre-arrest bail already allowed to the petitioner is confirmed subject to his furnishing fresh bail bonds in the sum of Rs. 2,00,000/- with one surety in the like amount to the satisfaction of learned trial Court.
