“….further that no independent witness of the
locality where the incident took place, a „Bazar‟
joined, made case of the prosecution doubtful. It is
cardinal principle of Criminal Jurisprudence that
any genuine doubt arising out of the circumstances
of the case should be extended to the accused as of
the right and not as concession. It is difficult to say
that prosecution has proved its case beyond shadow
of doubt.”
