Section 157 (2) Cr.P.C. read with 24.4 (1) of the Police Rules

 In this regard, reference can be made to section 157 (2) Cr.P.C. read with 24.4 (1) of the Police Rules, 1934. It is equally important to mention here that almost a similar view was expressed by the Hon’ble Supreme Court of Pakistan in the case of Sarwar and others v. The State and others (2014 SCMR 1762) which is as under:- 

“It had not been appreciated in the cases of Noor Nabi and Luqman Ali that even in cases of the most heinous offences the police, not to speak of a court, is under the statutory obligation, to necessarily and straightway arrest an accused person during an investigation as long as he is joining the investigation and is cooperating with the same.”
