Registration of impugned FIRs by the local police, was unwarranted and was lodged without having lawful authority, as if story narrated therein is presumed to be true for the sake of arguments, the provisions of PPC did not attract, as held by the Hon'ble Supreme Court of Pakistan in Mushahid Shah’s case, as the same covers the FIO and is exclusively triable by Banking Court, constituted therein. More-over, by lodging the FIRs by the complainants, it seems that the Financial Institution in order to avoid the guidelines given by the Hon'ble Supreme Court of Pakistan, has made a belated attempt to manipulate the things.
