The offence under section 337-G PPC is punishable with arsh or daman specified for the kind of hurt caused and may also be punished with imprisonment of either description for a term which may extend to five years as ta’zir. It is important to note that, so far as the sentence of imprisonment is concerned, section 337-G PPC is exhaustive. It does not say that the offender shall also be liable to imprisonment provided for the hurt caused. In this view of the matter, the addition of sections 334, 336, 337-F(i) and 337-F(v) PPC in the FIR is inapt and unwarranted.
