It is by now well settled that if the prosecution evidence is disbelieved then statement of an accused is to be accepted or rejected in toto. If statement of appellant is accepted in toto, then to his extent, it is a case punishable under Section 302 (c) of PPC and not a case punishable under Section 302 (b) of PPC.
