ایس ۔ 497 (2)-پاکستان پینل کوڈ ، 1860 (1860 کا ایکس ایل وی) ایس ۔ 489-ایف-ضمانت ، - - چیک کی بے عزتی - - مزید تفتیش - - کوئی پچھلا مجرمانہ ریکارڈ نہیں - - بار کے پیچھے - - شکایت کنندہ کے ساتھ کسی بھی کاروباری دستاویز سے انکار کرتا ہے - - اس کا کوئی سابقہ مجرمانہ ریکارڈ نہیں ہے ، شکایت کنندہ کے ساتھ کسی بھی کاروباری معاہدے سے انکار کرتا ہے جبکہ تفتیشی افسر کا مذکورہ بالا طرز عمل پہلی نظر میں اس کی طرف سے بدنیتی کی عکاسی کرتا ہے اور اس سے یہ کیس درخواست گزار کے جرم کی مزید تحقیقات میں سے ایک بن جاتا ہے ۔ - جو بھی ہو ، وہ اپنی گرفتاری کے بعد سے سلاخوں کے پیچھے ہے حالانکہ مزید تفتیش کے مقصد کے لیے اس کی ضرورت نہیں ہے - بیان کردہ حقیقت اسے گرفتاری کے بعد ضمانت دینے سے محروم کرنے کے لیے کافی نہیں ہے جب اس نے اپنے مقدمے کو اپنے جرم کی مزید تحقیقات میں سے ایک بنا دیا ہے-ضمانت منظور کر لی گئی ۔

Through this petition, petitioner has sought post arrest bail in case F.I.R No. 690 dated 09.10.2019, registered for offence under Section 489-F, PPC, at Police Station City Hafizabad, District Hafizabad.
2. Arguments heard. Record perused.
3. It has straightaway been observed that Investigation Officer has not investigated this case regarding the alleged liability against which subject cheque reportedly was issued by the petitioner. He having no previous criminal record, denies any business deal with the complainant while the above mentioned conduct of the Investigation Officer prima facie, reflects mala fide on his part and that makes this case one of further inquiry into petitioner’s guilt. Be that as it may, he is behind the bars since his arrest on 04.07.2025 though no more required for further investigation purpose. The complainant has not still instituted suit for recovery of the subject amount despite of the fact that cheque was returned by the bank during the year 2019. Conclusion of trial is not in sight. Keeping the petitioner incarcerated till indefinite period in the light of circumstances mentioned above, is neither likely to serve any useful purpose nor seems justified. So far as abscondence of the petitioner argued by learned prosecutor is concerned, this Court is of the opinion that said fact is not sufficient to disentitle him to the grant of post arrest bail when he has made out his case one of further inquiry into his guilt. Hence, this petition is allowed and petitioner is admitted to post arrest bail subject to his furnishing bail bonds in the sums of
Rs. 5,00,000/-with two sureties each in the like amount to the satisfaction of learned trial Court.
