ایس ۔ 498-پاکستان پینل کوڈ ، 1860 (1860 کا ایکس ایل وی) ایس ۔ 419 ، 420 ، 468 ، 471 ، 506-بی اور 170-قبل از گرفتاری ضمانت ، برخاستگی - ذاتی حاضری کی تقسیم کے لیے کوئی درخواست پیش نہیں کی گئی-ایف آئی آر کے مطابق ، درخواست گزار نے خود کو وکیل کے ساتھ ساتھ فوجی افسر کے طور پر پیش کرتے ہوئے دھوکہ دہی کا ارتکاب کیا-کسی کو بھی رابطہ کرنے کی اجازت نہیں دی جا سکتی ۔ اس کی اپنی پسند کے وقت عدالتیں-گرفتاری سے پہلے کی ضمانت ایک غیر معمولی راحت ہے ، مبینہ واقعہ میں درخواست گزار کا طرز عمل اور عدالت کے سامنے اس کا طرز عمل ، اسے درخواست کی گئی راحت کے لیے نااہل قرار دیتا ہے ۔

Order
Despite repeated calls, petitioner has not turned up before the Court. In pre-arrest bail, personal attendance of petitioner, unless dispensed with, is mandatory. No application seeking dispensation of personal attendance has been moved. Yesterday, the petitioner was present and on the request of vice counsel the matter was fixed for today but today the petitioner became absent. As per F.I.R, the petitioner while posing himself a lawyer as well as Army Officer committed cheating. I.O in attendance submits that during the course of investigation petitioner was found fully involved in the occurrence. Instant FIR was registered on 27.05.2025 and since then petitioner is enjoying premium of pre-arrest bail. No one can be allowed to approach the Courts at the time of his own choice/whim. Pre-arrest bail is an extra ordinary relief, the conduct of the petitioner in the reported occurrence as well as his conduct before the Court, disentitles him for the prayed relief.
2. In view of above, instant petition stands dismissed and ad-interim pre-arrest bail already granted to the petitioner vide order dated 03.07.2025 is hereby recalled.
