اس کیس کو حکم قانون 1984 کے آرٹیکل 40 کے دائرے میں لانے کے لیے استغاثہ کو یہ ثابت کرنا ہوگا کہ پولیس افسر کی حراست میں کسی بھی جرم کے ملزم نے پولیس کو اطلاع دی ہے یا بیان دیا ہے ، جس سے جرم سے متعلق نئی حقیقت کا پتہ چلتا ہے ، جو پولیس کے پیشگی علم میں نہیں ہے ۔ ایسی معلومات یا بیان تحریری طور پر اور گواہوں کی موجودگی میں ہونا چاہیے ۔ کسی شخص کی طرف سے معلومات یا بیان کی عدم موجودگی میں ، جس پر پولیس افسر کی تحویل میں کسی جرم کا الزام ہے ، صرف حقائق کی دریافت ، استغاثہ کے معاملے کو مذکورہ آرٹیکل کے تحت نہیں لائے گی ۔ استغاثہ کے مطابق ، اپیل گزار کے انکشاف اور اشارہ پر جرم کے ارتکاب میں استعمال ہونے والا تلوار برآمد کیا گیا ۔ حیرت کی بات یہ ہے کہ آئی او نے اپیل کنندہ سے موصول ہونے والی معلومات کو تحریری طور پر ، گواہ کی موجودگی میں ، اس وقت ریکارڈ نہیں کیا جب وہ پولیس کی تحویل میں تھا ۔ استغاثہ اپیل گزار کی طرف سے کوئی انکشاف کرنے میں ناکام رہا ہے ، اس لیے حالات میں تلوار کی بازیابی بے معنی تھی ۔
یہ قانون کا ایک طے شدہ اصول ہے کہ ایک دستاویزی ثبوت اپنے ساتھ سچائی کا مفروضہ رکھتا ہے ، اس لیے پوسٹ مارٹم رپورٹ اور ڈاکٹر کے بیان پر یقین نہ کرنے کی کوئی وجہ نہیں ہے ، جو اس حقیقت کو ثابت کرتا ہے کہ زخمی کافی طویل عرصے تک واقعے کی جگہ پر رہے ۔ اگر شکایت کنندہ اور پی ڈبلیو واقعے کی جگہ اور وقت پر موجود ہوتے تو زخمیوں کو بغیر وقت ضائع کیے ہسپتال لے جایا جا سکتا تھا اور اس طرح سخت موت نہیں ہو سکتی تھی ۔ یہ بات بھی قابل غور ہے کہ اپنے کراس معائنے میں ، ڈاکٹر نے وضاحت کی کہ چوٹیں قمری شکل کی تھیں ، جس کا مطلب ہے کہ شاید ، چوٹیں قمری شکل کے ہتھیار کی وجہ سے ہوئیں ۔ اس کے برعکس ، شکایت کنندہ اور چشم دید گواہوں نے الزام لگایا کہ اپیل کنندہ نے متوفی پر تلوار سے وار کیا ۔ متوفی کو لگنے والے زخموں کی نوعیت اور استعمال شدہ ہتھیار کے بارے میں ان کے بیانات پوسٹ مارٹم رپورٹ اور ڈاکٹر کے بیان سے متصادم ہیں ۔ ہم اس حقیقت سے آگاہ ہیں کہ صرف اس وجہ سے کہ گواہوں کا تعلق متوفی سے ہے ، ان کی شہادتوں کو نظر انداز نہیں کیا جا سکتا ، تاہم ، یہ بھی ضروری ہے کہ ایسے گواہوں کی شہادتوں کی زیادہ احتیاط اور احتیاط کے ساتھ جانچ پڑتال کی جائے ۔ یہاں زیر بحث حقائق یہ واضح کرتے ہیں کہ گواہوں کا طرز عمل غیر فطری تھا ۔ یہ ہمیں اس نتیجے پر لے جاتا ہے کہ جرم کے وقت گواہوں کی موجودگی مشکوک تھی ، اس طرح یہ واقعہ نظر انداز ہوتا ہے ۔
In order to bring the case within the ambit of Article 40 of the Qanun-e-Shahadat Order, 1984, the prosecution must prove that a person accused of any offence, in custody of police officer, has conveyed an information or made a statement to the police, leading to discover of new fact concerning the offence, which is not in the prior knowledge of the police. Such information or statement should be in writing and in presence of witnesses. In absence of information or statement from a person, accused of an offence in custody of police officer, discovery of fact alone, would not bring the case of the prosecution under the said Article. According to the prosecution, a dagger used in the commission of the offence was recovered on the disclosure and pointation of the appellant. Surprisingly, the IO did not record the information received from the appellant in -writing, in presence of a witness, while he was in police custody. The prosecution has failed to establish any disclosure from the appellant, therefore, recovery of the dagger, in the circumstances was immaterial.

 It is a settled principle of law that a documentary evidence carries with it a presumption of truth, therefore, there is no reason to disbelieve the postmortem report and the statement of the doctor, which proves the fact that the injured remained at the place of the occurrence for a considerable long period of time. Had the complainant and PW been present at the place and time of the occurrence, the injured could have been taken to the hospital, without loss of time and thereby, rigor mortis could not have been developed. It is also worth noting that in his cross examination, the doctor explained that the injuries were lunar shaped, which means that probably, the injuries was caused through lunar shaped weapon. On the contrary, the complainant and the eye-witnesses alleged that the appellant inflicted dagger blows on the deceased. Their statements regarding nature of the injures sustained by the deceased and the weapon used contradict the postmortem report and the statement of the doctor. We are conscious of the fact that just because the witnesses are related to the deceased, their testimonies cannot be disregarded, however, it is also important that testimonies of such witnesses have to be scrutinized with greater care and circumspection. The facts discussed herein makes it clear that the conduct of the witnesses was unnatural. It leads us to a conclusion that presence of the witnesses at the time of the crime was doubtful, as such the occurrence seems to be unseen.
