کیس کی منسوخی-- مجسٹریٹ کی طرف سے معاہدہ---تنازعہ ایس ۔173 ، ضابطہ فوجداری کے تحت تفتیشی رپورٹ پیش کرنے کے حوالے سے تھا ۔ کیس کی منسوخی کی سفارش کی لیکن ٹرائل کورٹ نے اس سے اتفاق نہیں کیا اور ٹرائل کے ساتھ آگے بڑھنے کا انتخاب کیا---زیریں اپیلٹ کورٹ نے نظر ثانی کے دائرہ اختیار کا استعمال کرتے ہوئے ٹرائل کورٹ کے ذریعے منظور کردہ حکم کو کالعدم قرار دیا---جواز-- مجسٹریٹ (ٹرائل کورٹ) کافی قابل تھا اور منسوخی کی رپورٹ سے اختلاف کرنے کا دائرہ اختیار رکھتا تھا ، اور اس معاملے کا نوٹس لیتے ہوئے ملزم کو مقدمے کا سامنا کرنے کے لیے طلب کیا تھا-- مجسٹریٹ (ٹرائل کورٹ) نے گواہوں کی فہرست پیش کرنے کے لیے متعلقہ اسٹیشن ہاؤس آفیسر کو ہدایت جاری کی - مجسٹریٹ (ٹرائل کورٹ) کے ذریعے منظور کیا گیا ایسا حکم قانون کے ساتھ ساتھ کیس کے حقائق کے مطابق تھا ۔ - لوئر اپیلٹ کورٹ نے اپنے فیصلے میں ڈپٹی سپرنٹنڈنٹ آف پولیس کے ذریعہ کی جانے والی تحقیقات کی کارروائی اور ایس ۔173 ، ضابطہ فوجداری کے تحت رپورٹ مرتب کرنے کے ساتھ ساتھ رپورٹ جمع کرنے کے حوالے سے جاری کردہ ان کی ہدایت پر غور نہیں کیا ۔ --زیریں اپیلٹ عدالت نے اپنا فیصلہ منظور کرتے وقت حلف نامے کی فوٹو کاپی پر بھی غور کیا ، جو اس موضوع پر قانون کے طے شدہ اصول کے ساتھ ساتھ کیس کے مخصوص حقائق اور حالات کے خلاف تھا اور یہ قانون کی نظر میں پائیدار نہیں تھا ۔ - ہائی کورٹ ، انصاف کے مقاصد کو حاصل کرنے کے لیے ، لوئر اپیلیٹ کورٹ کے ذریعے منظور کیے گئے فیصلے کو کالعدم قرار دے کر مجسٹریٹ (ٹرائل کورٹ) کے ذریعے منظور کیے گئے حکم کو بحال کر دیا گیا -
Cancellation of case---Disagreement by Magistrate---Dispute was with regard to submission of investigation report under S.173, Cr.P.C. recommending cancellation of the case but Trial Court did not agree with the same and opted to proceed with trial--- Lower Appellate Court in exercise of revisional jurisdiction set aside the order passed by Trial Court--- Validity--- Magistrate (Trial Court) was quite competent and possessed jurisdiction to disagree with cancellation report, and had summoned accused to face trial, while taking cognizance of the matter--- Magistrate (Trial Court) issued direction to Station House Officer concerned for submitting list of witnesses--- Such order passed by Magistrate (Trial Court) was in accordance with law as well as facts of the case--- Lower Appellate Court in its judgment did not consider proceedings of investigation conducted by Deputy Superintendent of Police and his direction issued regarding compiling as well as submitting report under S.173, Cr.P.C.--- Lower Appellate Court also took into consideration photocopy of an affidavit, while passing his judgment, which was against the settled principle of law on the subject as well as peculiar facts and circumstances of the case and the same was not sustainable in the eyes of law---High Court, for securing ends of justice, set aside judgment passed by Lower Appellate Court and order passed by Magistrate (Trial Court) was restored--
