جہاں کیس جس میں سیکشن 517 ، ضابطہ فوجداری کے تحت ایک حکم ہے. منظور کیا گیا تھا خود میں اپیل یا نظر ثانی کی عدالت کے سامنے زیر التواء ہے ، کہ عدالت سیکشن 520 ، ضابطہ فوجداریکے تحت اس طرح کے حکم میں ترمیم ، منسوخ یا تبدیل کر سکتی ہے. سیکشن 520 ، ضابطہ فوجداری. اعلی عدالت کو سیکشن 517 ، 518 اور 519 ،ضابطہ فوجداری کے تحت نچلی عدالت کے ذریعہ منظور کردہ حکم میں مداخلت کرنے کا اختیار دیتا ہے ۔ لیکن یہ کسی بھی طرح سے ٹرائل کورٹ کو اعلی عدالت کے حکم کے نتیجے میں اور اس کی تعمیل میں کوئی حکم منظور کرنے سے نہیں روکتا ہے ، لیکن جہاں ایسا کوئی مقدمہ زیر التواء نہیں ہے ، تو اس سیکشن کے تحت عدالت میں ایک درخواست ہے جس میں اپیل یا ترمیم عام طور پر ماتحت عدالت کے حکم سے دفعہ 517 ، ضابطہ فوجداری
Section 32 of the Control of Narcotic Substances Act,1997 is controlled by section 33 of of the Control of Narcotic Substances Act,1997, which provides that even in case of acquittal of a person charged with offence, such acquittal of the accused ipso-facto will not absolve the vehicle used in the commission of offence of liability of the consequences and the Special Court shall decide whether any article frozen or seized in connection with such offence is liable to confiscation. The sections 32 and 33 of the Control of Narcotic Substances Act,1997 empower the trial court to order confiscation of a vehicle used in transport of narcotic substance subject to that, according to the provisos to 32 and 33 of the Control of Narcotic Substances Act,1997 , the vehicle shall not be confiscated unless it is proved that owner was aware that his vehicle was being used in the crime and in this respect burden has been placed on the prosecution to establish that the owner of the vehicle had the knowledge of his vehicle being used in the crime. In the instant case, the record of the case is silent as to whether any query or probe had been made during investigation of the case or even during trial or any substantial proof was brought on record by the prosecution about involvement of the appellant i.e. the owner of the vehicle or his knowledge of transporting the narcotic substance by the accused named in the F.I.R.
