تیسری شق 497 ضابطہ فوجداری اس سے پتہ چلتا ہے کہ اگر کسی شخص کا مقدمہ جس پر سزائے موت کے قابل جرم کا ارتکاب کرنے کا الزام ہے ، اس کی حراست کے دو سال کے اندر ختم نہیں ہوتا ہے ، تو وہ گرفتاری کے بعد ضمانت کی رعایت کا حقدار بن جاتا ہے ۔ اسے سیکشن 497 ضابطہ فوجداری کی تیسری شق کے تحت گرفتاری کے بعد ضمانت کی راحت سے محروم رکھا جاسکتا ہے ۔ صرف اس صورت میں جب یہ ظاہر کیا جائے کہ اس طرح کی تاخیر ضمانت مانگنے والے ملزم کے کسی عمل یا غلطی کی وجہ سے یا اس کی طرف سے کام کرنے والے کسی دوسرے شخص کی وجہ سے ہوئی ہے ۔ یہ معروف ٹرائل کورٹ کی رپورٹ سے ظاہر ہوتا ہے اور ریکارڈ کرتا ہے کہ ٹرائل کے اختتام میں تاخیر کو کسی بھی طرح سے درخواست گزار یا اس کی طرف سے کام کرنے والے کسی شخص سے منسوب نہیں کیا جا سکتا ۔ اس چوتھے پروویسو میں تصور کیا گیا ہے کہ سیکشن 497 ضابطہ فوجداری کے تیسرے پروویسو کا فائدہ کسی ایسے شخص تک نہیں بڑھایا جائے گا ، جو سزائے موت یا عمر قید کی سزا کے قابل جرم میں سزا یافتہ ہے یا ایک سخت ، مایوس کن یا خطرناک مجرم ہے یا ایک شخص ، جو دہشت گردی کے عمل میں ملوث ہے جس کی سزا موت یا عمر قید ہے ۔ یہاں یہ ذکر کرنے کی ضرورت نہیں ہے کہ دفعہ 497 ضابطہ فوجداری کی چوتھی شق کے اندر کسی ملزم کے کیس کو لانے کے لئے ، استغاثہ کو کچھ مواد کے حوالے سے اپنے کارڈ دکھانے ہوں گے ۔ فوری معاملے میں ، ریکارڈ پر ایسا کوئی موقف موجود نہیں پایا جاتا ہے ، جو درخواست گزار کے معاملے کو دفعہ 497 ضابطہ فوجداری کی چوتھی شق کے اندر لا سکتا ہے ۔
ایڈیشنل پراسیکیوٹر جنرل کی طرف سے گرفتاری کے بعد فوری ضمانت کو مسترد کرنے کی زور شور سے اس بنیاد پر اپیل کی گئی ہے کہ نمایاں مفرور پن کو درخواست گزار سے منسوب کیا گیا ہے ۔ اس سلسلے میں یہ کہنا کافی ہے کہ اگر کسی ملزم کا معاملہ مزید تفتیش کے دائرے میں آتا ہے تو اس کی سابقہ مفرورگی کو گرفتاری کے بعد ضمانت کی منظوری میں رکاوٹ کے طور پر استعمال نہیں کیا جا سکتا ۔
The 3rd proviso of section 497 Cr.P.C. unfolds that if the trial of a person accused of having committed an offence punishable with death is not concluded within two years of his detention, he becomes entitled to the concession of post-arrest bail. He can be held disentitled from the relief of post arrest bail under 3rd proviso of section 497 Cr.P.C. only if it is demonstrated that such delay has been caused or occasioned by an act or omission of the accused seeking bail or by any other person acting on his behalf. It manifests from the report of the learned trial court and record that the delay in the conclusion of trial can in no manner be attributed to the petitioner or any person acting on his behalf. This is envisaged in the 4th proviso that the benefit of 3rd proviso of section 497 Cr.P.C will not be extended to a person, who is convicted in an offence punishable with death or imprisonment for life or is a hardened, desperate or dangerous criminal or a person, who is involved in an act of terrorism punishable with death or imprisonment for life. Needless to mention here that in order to bring the case of an accused within the 4th proviso of section 497 Cr.P.C., the prosecution has to display its cards in reference to some material. In the instant case, no such stance is found present on the record, which may bring the case of the petitioner within the 4th proviso of section 497 Cr.P.C.
The dismissal of instant post arrest bail is vociferously urged by the learned Additional Prosecutor General on the ground that noticeable abscondance is attributed to the petitioner. Suffice it to say in this regard that if the case of an accused comes within the ambit of further inquiry, his previous abscondance cannot be used as hurdle for the grant of post arrest bail.
