سیکشن 497 (1) ضابطہ فوجداری کے تیسرے پروویسو کی شق (اے ۔) کے مشاہدے سے ، یہ واضح ہے کہ کسی بھی جرم کا ملزم موت سے قابل سزا نہیں ہے ، جسے اس طرح کے جرم کے لئے ایک سال سے زیادہ عرصے تک حراست میں رکھا گیا ہے اور اس طرح کے جرم کے لئے مقدمے کی سماعت ختم نہیں ہوئی ہے ، جبکہ ، ملزم کے مقدمے کی سماعت میں تاخیر ملزم یا اس کی طرف سے کام کرنے والے کسی دوسرے شخص کے عمل یا غلطی کی وجہ سے نہیں ہوئی ہے ، عدالت ہدایت کرے گی کہ اس طرح کے ملزم کو ضمانت پر رہا کیا جائے گا ۔ یہ نوٹ کرنا مناسب ہے کہ قانونی تاخیر کی بنیاد پر ضمانت پر ملزم کی رہائی کے مقاصد کے لیے ، عدالتوں کو اس بات کی جانچ کرنے کی ضرورت ہے کہ آیا تاخیر ملزم یا صرف اس کی طرف سے کام کرنے والے کسی دوسرے شخص کے کسی عمل یا غلطی کی وجہ سے ہوئی ہے ۔ ایک بار جب اس طرح کی ذمہ داری ملزم کی طرف سے خارج کردی جاتی ہے ، تو مقدمے کی سماعت کے اختتام میں تاخیر کی کوئی اور وجہ نہیں ، خاص طور پر ، استغاثہ کی جانب سے ایک سال سے زیادہ عرصے تک زیر سماعت قیدی کو عدالت میں پیش کرنے میں ناکامی جیسا کہ دفعہ 497 (1) ضابطہ فوجداری کے تیسرے پروویسو کی شق (اے ۔) میں فراہم کیا گیا ہے ، ملزم کی طرف سے ایک عمل یا غلطی کے طور پر سمجھا جاسکتا ہے ، اس وجہ سے کہ زیر سماعت قیدی کو سماعت کی ہر تاریخ پر عدالت میں پیش کرنا استغاثہ کی ذمہ داری ہے ، جبکہ استغاثہ کی طرف سے ناکامی کی صورت میں ، عدالت کا فرض ہے کہ وہ زیر سماعت قیدی کی پیش کش کو یقینی بنائے ۔ ملزم کے پروڈکشن وارنٹ کا حکم منظور کرتے ہوئے ۔ فوری معاملے میں ، ریکارڈ سے پتہ چلتا ہے کہ استغاثہ نے ملزم کی پیش کش کو یقینی بنانے کے لئے کوئی کوشش نہیں کی ، نہ ہی ڈیڑھ سال سے زیادہ عرصہ گزرنے کے باوجود ٹرائل کورٹ کے سامنے استغاثہ کے گواہوں کو پیش کیا اور نہ ہی ٹرائل کورٹ کے ذریعہ اس سلسلے میں 13.04.2026 کو سپرنٹنڈنٹ سنٹرل جیل اڈیالہ ، راول پنڈی کو ہدایت دینے کے حکم کی تعمیل کی گئی ۔ استغاثہ کی طرف سے یہ عمل ، سپرنٹنڈنٹ سنٹرل جیل اڈیالہ ، راول پنڈی کی طرف سے ملزم کو پیش کرنے کے عدالت کے حکم کی عدم تعمیل اور ٹرائل کورٹ کی طرف سے ملزم کو عدالت میں پیش کرنے کو یقینی بنانے کے لئے غلطی کی گئی ہے ۔ دفعہ 489-ایف پی پی سی کے تحت کسی ملزم کے سلسلے میں مقدمے کی سماعت کے مقاصد کے لئے ، جو تین سال تک کی قید یا جرمانے سے قابل سزا ہے ، یا دونوں کے ساتھ ، ایسے ملزم کی ضمانت روکنا جو پہلے ہی ڈیڑھ سال سے زیادہ عرصے سے عدالتی حراست میں رہا ہے ۔ قانونی بنیاد پر ضمانت پر رہائی سے انکار کرکے ، جب ملزم پہلے ہی اپنی زیادہ سے زیادہ سزا کاٹ چکا ہے تو ضمانت کے حق (آزادی) اور زیر سماعت قیدی کے منصفانہ مقدمے کی سماعت کے حق سے بھی انکار کرنے کے مترادف ہے ۔ مقدمے کی سماعت کے اختتام میں تاخیر کی بنیاد پر رہا ہونے کے ملزم کے حق کو قانون کے ذریعہ محفوظ کیا گیا ہے ، جو تقاضوں کی تکمیل سے مشروط ہے ، عدالت (ج) پر زیر سماعت قیدی کو دیئے گئے اس طرح کے قانونی فائدے کو بڑھانے کے لئے شاید ہی کوئی صوابدید چھوڑتا ہے ، استغاثہ یا عدالتیں قانون کے ذریعہ فراہم کردہ ملزم کو دستیاب اس طرح کی قانونی رعایت سے حسد نہیں کریں گی ، لہذا ، صرف اس طرح کے قانونی فائدے کو خارج کرنے کے لئے فراہم کردہ مستثنیات کے تحت ، عدالتوں کو ملزم کے حق میں اس طرح کی صوابدید کا استعمال کرنے کے لئے فعال ہونا چاہئے ۔ 

From perusal of clause (a) of third proviso to section 497(1) Cr.P.C, it is clear that any person accused of any offence not punishable with death, who has been detained for such offence for a continuous period exceeding one year and whose trial for such offence has not concluded, whereas, the delay in the trial of the accused has not been occasioned by an act or omission of the accused or any other person acting on his behalf, the court shall direct that such accused shall be released on bail. It is pertinent to note for the purposes of seeking release of an accused on bail on the ground of statutory delay, the courts are required to examine as to whether the delay has been occasioned by an act or omission of the accused or any other person acting on his behalf only. Once such onus is discharged by the accused, no other reason whatsoever for the delay in conclusion of the trial, particularly, the failure of the prosecution to produce the under trial prisoner in court for a period exceeding one year as provided in clause (a) of third proviso of section 497(1), Cr.P.C, can be considered as an act or omission on the part of accused, for the reason to produce the under trial prisoner before the court on each date of hearing is the responsibility of the prosecution, whereas, in case of failure on the part of prosecution, it is the duty of the court to ensure production of the under trial prisoner by passing an order for production warrants of the accused. In the instant matter, record shows that prosecution did not make any effort, whatsoever to ensure production of the accused, nor produced prosecution witnesses before the Trial Court in spite of lapse of more than one and a half year nor the order passed by the Trial Court to this effect on 13.04.2026 directing the Superintendent Central Jail Adeyala, Rawalpindi was complied with. This conduct on the part of the prosecution, noncompliance of the court's order for production of the accused by the Superintendent Central Jail Adeyala, Rawalpindi and omission on the part of the Trial Court to ensure production of the accused in court for the purposes of trial in a case in respect of an accused for an offence under section 489-F PPC, which is punishable with imprisonment which may extend to three years, or with fine, or with both, withholding bail of such an accused who has already remained in judicial custody for more than one and a half year by denying his release on bail on statutory ground, when the accused has already served out his maximum punishment amounts to denying the right of bail (liberty) and also the right of fair trial to under trial prisoner. The right of an accused to be released on the ground of delay in conclusion of trial has been protected by the statute, which subject to fulfilment of the requirements, hardly leaves any discretion to the court(s), to extend such statutory benefit given to an under trial prisoner, the prosecution or the courts shall not be jealous about such statutory concession available to an accused provided by law, therefore, only under the exceptions provided for excluding such statutory benefit, the courts must be proactive to exercise such discretion in favour of the accused.
