Nevertheless, the first step is the effective
enforcement of the laws on the Statute Book which is the duty of the
government and its functionaries. In R. v. Commissioner of Police for
the Metropolis [All ER (1968)2 QB 118] Lord Denning held:
“A question may be raised as to the machinery by which he
(Commissioner of Police) could be compelled to do his duty. On
principle, it seems to me that once a duty exists, there should be a
means of enforcing it. This duty can be enforced. I think, either by
action at the suit of the Attorney-General or by the prerogative
order of mandamus.”
