دفعہ 5، دی ٹارچر اینڈ کسٹوڈیل ڈیتھ (پریوینشن اینڈ پنشمنٹ) ایکٹ، 2022 کے تحت، صرف ایف۔آئی۔اے کو یہ اختیار حاصل تھا، باقی تمام اداروں کو خارج کرتے ہوئے، کہ وہ اس ایکٹ کے تحت جرم کرنے والے سرکاری اہلکاروں کے خلاف شکایت کی تحقیقات کرے۔ مذکورہ شق ایک غیر اثر انداز ہونے والی شق تھی جو الفاظ
"Notwithstanding"
سے شروع ہوتی ہے، جو اس شق کو ایک فوقیت اثر دیتی ہے۔ یہ مزید فراہم کرتی ہے کہ تحقیقات کی نگرانی قومی کمیشن برائے انسانی حقوق (جسے بعد ازیں کمیشن کہا جائے گا) کرے گا، اگرچہ نگرانی کے مینڈیٹ کی تفصیلات کی وضاحت نہیں کی گئی ہے۔ ایف۔آئی۔اے، کسی جرم کی تحقیقات کرتے ہوئے، ایف۔آئی۔اے ایکٹ، 1974 اور اس کے تحت بنائے گئے قواعد پر عمل کرے گا۔
حراستی زیادتی کے واقعات کی انکوائری اور تحقیقات ایف۔آئی۔اے ایکٹ، 1974 کے ساتھ ملا کر ایکٹ، 2022 کے تحت ایف۔آئی۔اے کرے گا اور انسداد عصمت دری (تحقیقات اور مقدمہ) ایکٹ، 2021 کی دفعات کو ثانوی اہمیت اور اطلاق دیا جائے گا۔
Under Section 5 THE TORTURE AND CUSTODIAL DEATH (PREVENTION AND PUNISHMENT) ACT, 2022 , only F.I.A. was empowered to the exclusion of all the other agencies to investigate the complaint against public officials committing the offence under the Act. Said provision was a non obstante clause starting from the words “Not withstanding”, which gives the said provision an overriding effect. It further provides that investigation shall be supervised by National Commission for Human Rights (hereinafter called as Commission), although specifics of the supervisory mandate has not been defined. F.I.A., while investigating a crime, shall follow F.I.A. Act, 1974 and the rules made thereunder.
Cases of the custodial rape shall be inquired into and investigated by F.I.A. under the Act, 2022 read with F.I.A. Act, 1974 and the rules made thereunder and the provisions of Anti-rape (Investigation and Trial) Act, 2021 shall be given secondary importance and applicability.
