یہ بات ذہن نشین رہے کہ اب یہ قانون کا مسلمہ اصول ہے کہ کسی زخمی گواہ کا بیان محض زخمی ہونے کی بنا پر حرفِ آخر نہیں مانا جائے گا۔ ایسے شواہد کو بھی دیگر شواہد کی طرح ساکھ، تسلسل اور تصدیق کی بنیاد پر جانچنا ہوگا۔ زخمی کے بیان کا جائزہ کیس کے حقائق اور حالات کو مدنظر رکھتے ہوئے اس کی اپنی خوبیوں کی بنیاد پر لیا جانا چاہیے۔

یہ ایک عام قانون ہے کہ برآمدگی محض ایک تائیدی ثبوت ہے۔ ایک بار جب اس عدالت نے طبی شہادت سے متصادم ہونے کی بنا پر عینی شاہد کے بیان کو مسترد کر دیا تو ایسی برآمدگی، تنہا کھڑے ہو کر، کوئی آزادانہ قابلِ قدر ثبوت نہیں رکھتی اور استغاثہ کے مقدمے کی کوئی تائید نہیں کرتی۔

یہ ہماری فوجداری فقہ کا ایک قائم شدہ اصول ہے کہ جہاں ایف آئی آر بغیر کسی معقول جواز کے نمایاں تاخیر سے درج کی جاتی ہے، تو یہ سمجھا جاتا ہے کہ ایسا وقت ایک فرضی کہانی گھڑنے کے لیے غور و خوض اور مشاورت میں صرف کیا گیا تھا۔

ایک گواہ جسے اپنے ہی ستانے والے کے حوالے سے جھوٹا قرار دیا گیا ہو، مقدمے کے بقیہ ڈھانچے کو برقرار رکھنے کے لیے اس کی کوئی اہمیت نہیں ہے۔

مزید یہ کہ پوسٹ مارٹم امتحانات کی رپورٹس اور انکوائری رپورٹس سے یہ بات مشاہدے میں آئی ہے کہ لاشوں کو پولیس ہسپتال لائی اور ان کی شناخت دو ایسے افراد نے کی جو مبینہ عینی شاہد نہیں تھے۔ مزید برآں، عینی شاہدین، جو مرحومین کے قریبی رشتہ دار ہیں، نے بھی لاشوں کی شناخت نہیں کی جس سے ان کی ساکھ مزید کمزور ہوتی ہے۔ جائے وقوعہ پر ان کی موجودگی کے کسی ٹھوس ثبوت کی عدم موجودگی میں، ان کے بیان پر انحصار نہیں کیا جا سکتا۔ ان کے بیانات میں موجود مادی تضادات، مرحومین کے ساتھ نہ ہونے یا سرکاری رپورٹس میں شناخت کنندگان کے طور پر درج نہ ہونے کے ساتھ، اس بات کا قوی اشارہ دیتے ہیں کہ وہ وقوعہ کے وقت موجود نہیں تھے۔

 It is important to note that it is now a well-settled principle of law that testimony of an injured witness is not to be accepted as gospel truth merely on account of injury alone--Such evidence, like any other, must be evaluated on touchstone of credibility, consistency, and corroboration--The testimony of injured must be evaluated on its own merits considering facts and circumstances of each case.

It is trite law that recovery is merely a corroborative piece of evidence--Once ocular account has been disbelieved by this Court being in conflict with medical evidence, such recovery, standing alone, carries no independent probative value and is of no support to prosecution case.

It is an established proposition of our criminal jurisprudence that where the FIR is registered with a noticeable delay without any plausible justification, it is considered that such time was consumed in deliberation and consultation to cook up a fake story.

A witness discredited and disbelieved qua his own tormentor is of little relevance to sustain the remaining structure of the case.

It has been further observed from the post-mortem examination reports and inquest reports that the dead bodies were brought to the hospital by the police and identified by two individuals who were not the alleged eyewitnesses. Moreover, the eyewitnesses, who are closely related to the deceased did not even identify the bodies further weakens their credibility. In the absence of any tangible proof of their presence at the crime scene, their testimony cannot be relied upon. The material contradictions in their statements, along with their failure to accompany the deceased or be listed as identifiers in official reports, strongly indicate that they were not present at the time of the occurrence.
