ایس ایس۔ 440، 148 اور 149-- گرفتاری سے قبل ضمانت، منظوری-- الزام-- پانی کی کھال/آبی ذخیرہ کو مسمار کرنا-- درخواست گزاروں کے خلاف بنیادی الزام پانی کی کھال/آبی ذخیرہ کو مسمار کرنا ہے-- پٹواری، گرداور اور تحصیلدار کی رپورٹ کے مطابق، مذکورہ آبی ذخیرہ ریاستی ذخیرہ نہیں تھا بلکہ مشترکہ کھاتہ پر نجی طور پر بنایا گیا تھا-- مشترکہ کھاتہ درخواست گزاروں اور مدعی کا ہے-- مذکورہ مشترکہ کھاتہ تقسیم نہیں ہوا ہے اور ہر مالک زمین کے ہر انچ کا مالک ہے-- ایف آئی آر میں مذکور دونوں گواہان مدعی کے قریبی رشتہ دار ہیں-- ایف آئی آر میں کوئی آزاد گواہ پیش نہیں کیا گیا-- بلاشبہ، فریقین کے مابین دیوانی مقدمہ زیر التوا ہے-- مدعی کی جانب سے درخواست گزاروں کو جھوٹا ملوث کرنے کی بدنیتی کو رد نہیں کیا جا سکتا-- ضمانت منظور کی گئی۔

----S. 498--Pakistan Penal Code, 1860 (XLV of 1860), Ss. 440, 148 & 149--Bail before arrest, grant of--Allegation--Demolishing water Khaal/Water reservoir--The main allegation against petitioners is of demolishing water khaal/water reservoir--According to report of Patwari, Girdawar and Tehsildar, said water reservoir was not a State reservoir but privately made on joint khata-- The joint khata belongs to petitioners and complainant--The said joint khata has not been divided and each one of owner is owner of every inch of land-- Both witnesses mentioned in FIR are close relatives of complainant--No independent witness has been cited in FIR-- Admittedly, civil litigation is pending between parties--Mala fide on part of complainant for falsely implicating petitioners cannot be ruled out--Bail allowed.                                              [Para 5, 6, 7 & 8] A, B, C & D

Order

Muhammad Nazir alias Nazira, Muhammad Akram, Ismail and Ahmad Yar, petitioners seek bail before arrest in case FIR No. 212 dated 09.07.2015 offences under Sections 440, 148 and 149, PPC, registered at Police Station Midh Ranjha, District Sargodha.

2.       The allegation in the FIR, against the petitioners are that they along with their co-accused, while armed with their respective weapons, demolished the water reservoir (water khaal) of the complainant and caused irreparable loss to her crops.

3.       Arguments heard. Record perused.

4.       This incident, as per FIR, allegedly took place on 17.06.2015 whereas the matter was reported to the Police on 09.07.2015 with an unexplainable delay of 22 days.

5.       Admittedly, no one was injured in the said occurrence and the main allegation against the petitioners is of demolishing the water khaal/water reservoir. According to the report of the Patwari, Girdawar and Tehsildar, the said water reservoir was not a State reservoir but privately made on the joint khata.

6.       Admittedly the Petitioner No. 1 (Muhammad Nazir alias Nazira) is the real brother of the complainant and father of the Petitioners No. 2 to 4. The joint khata belongs to the petitioners and the complainant. The said joint khata has not been the divided and each one of the owner is owner of every inch of the land.

7.       Both the witnesses mentioned in the FIR namely Hayat and Ajmair are close relatives of the complainant. No independent witness has been cited in the FIR.

8.       Admittedly, civil litigation is pending between the parties. Mala fide on the part of the complainant for falsely implicating the petitioners cannot be ruled out.

9.       For what has been discussed above, this petition is allowed and ad-interim pre-arrest bail already allowed to the petitioners is hereby confirmed subject to their furnishing fresh bail bonds in the sum of Rs. 1,00,000/- each with one surety each in the like amount to the satisfaction of learned trial Court.

10.     However, it is made clear that the above findings are tentative in nature and shall have no bearing on the trial of the case.
