فوجداری نظرثانی--گواہ کی گواہی--طبی شہادت--ایک گواہ کا بیان، اگر بدنیتی یا عناد سے پاک ہو، تو اس پر یقین کیا جا سکتا ہے اور سزا ریکارڈ کرنے کے لیے اس پر انحصار کیا جا سکتا ہے، اگر یہ چوٹ کے معاملات میں طبی شہادت سے تائید حاصل کرے۔

ارش اور دمن درخواست گزار پچھلے چھ ماہ سے سلاخوں کے پیچھے ہے اور اسے سیکشن 337-روپے ، پی پی سی کے تحت ارش کی رقم کی قسطوں کے لیے دستیاب سہولت اس کے حق میں دی جائے ، کیونکہ وہ شاید اپنی ذمہ داری پوری کرنے کی پوزیشن میں ہوگا ۔ درخواست گزار کے وکیل کی اس طرح کی دلیل کو تسلیم کیا جاتا ہے-ان حالات میں ، سزا کے ساتھ ساتھ سزا i.e. ٹرائل کورٹ کے ذریعہ درج کردہ اور اپیلٹ کورٹ کے ذریعہ پیش کردہ ارش اور دمن برقرار رہیں گے - درخواست گزار کو دمن  کی رقم ادا کرنے کی ہدایت کی جاتی ہے ۔ روپے 30, 000/- چار ماہ کے اندر ، ڈیفالٹ میں ، قانون اپنا راستہ اختیار کرے گا-جہاں تک ارش کی ادائیگی کا تعلق ہے ، سیکشن 337-ایکس ، پی پی سی کے مطابق ، درخواست گزار کو ارش کی رقم 30,000 روپے ادا کرنے کی ہدایت کی گئی ہے ۔ 337895/- روپے کی شرح سے چھتیس مساوی ماہانہ قسطوں میں ۔ 9385/- ماہانہ ؛ ہر ماہ کی 5 تاریخ کو قابل ادائیگی جب تک کہ اوپر بیان کردہ ارش کی پوری رقم کی ادائیگی نہ ہو - پہلی قسط کی ادائیگی 05 نومبر 2024 کو کی جائے گی اور 10/2 بعد میں اس کے مطابق عمل کیا جائے گا-اگر درخواست گزار کسی قسط کی ادائیگی کرنے میں ناکام رہتا ہے تو قانون اپنا راستہ اختیار کرے گا-درخواست گزار کو جیل سے رہا کیا جائے گا (اگر ضرورت نہیں ہے تو کسی اور معاملے میں) بغیر کسی رقم کے ۔ 337895/- ٹرائل کورٹ کے سامنے-6 مکمل ادائیگی کے موقع پر ، ٹرائل کورٹ متعلقہ ریکارڈ میں اندراج کے لیے متعلقہ سپرنٹنڈنٹ جیل کو مطلع کرے گی-ترمیم مسترد کر دی گئی ۔

----S. 337-X--Criminal Procedure Code, 1898 (V of 1898), Ss. 435 & 439--Arsh and Daman--Petitioner is behind bars for last six months and facility available to him under Section 337-X, PPC for installments of Arsh amount be extended in his favour, as he would probably be in a position to discharge his liability--Such contention of counsel for petitioner is acceded to--In these circumstances, conviction as well as sentence i.e. Arsh and Daman recorded by trial Court and carried forward by appellate Court shall remain intact--Petitioner is directed to pay amount of Daman i.e. Rs. 30,000/- within four months, in default whereof, law shall take its own course--As regards payment of Arsh, pursuant to Section 337-X, PPC, petitioner is directed to pay Arsh amount of Rs. 337895/- in thirty six equal monthly installments at rate of Rs. 9385/- per month; payable on 5th of every month till payment of above said whole amount of Arsh--First installment will be paid on 05th of November, 2024 and 10/2 later shaft follow accordingly--If petitioner fails to make payment of any installment, law shall take its own course--Petitioner shall be released from Jail (if not required in any other case) subject to furnishing abond--Abond of Rs. 337895/- before trial Court--On eve of 6 payment in full, trial Court shall inform concerned Superintendent Jail for entry in respective record--Revision dismissed.        [Para 7] B

Judgment

Qais Ijaz “accused/petitioner” was sent to face trial in case FIR No. 136 dated 17.03.2018 under Sections 337-A(i)/337-A(ii), PPC registered at police station Lohari gate, Multan before the learned Magistrate Section-30, Multan and vide judgment dated 22.12.2023 he was convicted under Section 337-A(i), PPC and sentenced to pay Daman of Rs. 30,000/- to injured/complainant Sajjad Hussain and further on conviction under Section 337-A(ii), PPC to pay Arsh (5% of Diyat i.e. 337895/-) to Injured/complainant. Challenging his above conviction and sentence, the petitioner/convict filed appeal before the learned Additional Sessions Judge, Multan and the learned appellate Court vide judgment dated 19.03.2024 dismissed the appeal.

2.       Aggrieved by his above noticed conviction and sentence, the petitioner has filed instant criminal revision

3.       As per FIR Muhammad Faheem and one Akhtar were the alleged eye witnesses of the occurrence, apart from the injured himself. Reportedly Akhtar had died and Muhammad Faheem appeared in the dock as PW-2. Learned counsel for the petitioner contends that both the PWs of FIR were not working as employee in Government Islamia Wilayat Hussain College, Multan, rather related to the injured were not expected to be present at the place of occurrence. Further stated that neither the Principal. Teacher or Laboratory Attendant appeared in the dock in support of prosecution case. Adds that there is cloud on the recovery of iron rod which though as claimed was snatched by Akhtar at the place of occurrence, but later was shown recovered on the lead of accused on 21.03.2018; recovery of paper weight from the College is nothing but a mere attempt to fill the gap in evidence. The learned counsel also argued that injury under Section 337-A(i), PPC stands in conflict with the ocular account, as according to him the ocular account states injury in the center of the head, whereas, doctor has observed the locale on left side of head.

4.       On the other hand, learned Deputy Prosecutor General assisted by learned counsel for the complainant supported the judgments of two Courts below.

5.       Heard. Record perused.

6.       The main witness in this case is the injured himself and it is trite that testimony of a single witness, if not tainted with malafide or malice, can be believed and relied upon for recording conviction, if it gets support from the medical evidence in hurt cases. The injured Sajjad has given straight forward statement who though was cross-examined but nothing damaging to the prosecution or favourable to the defence could be elicited from him. What he has spoken stood verified from Dr. Amir Qayuum (PW-4) and no question was suggested to him with respect to nature, duration or size of the injury. A vague question of injuries being result of fabrication was not further challenged through any other evidence, therefore, a vague expression on the competency of the doctor is nothing but mere an eyewash. Thus, the prosecution has succeeded in proving its case beyond any shadow of doubt.

7.       At this stage the learned counsel for the petitioner contends that petitioner is behind the bars for the last six months and facility available to him under Section 337-X, PPC for installments of Arsh amount be extended in his favour, as he would probably be in a position to discharge his liability. Such contention of the learned counsel for the petitioner is acceded to. In these circumstances, the conviction as well as sentence i.e. Arsh and Daman recorded by the learned trial Court and carried forward by the learned appellate Court shall remain intact. However, the petitioner is directed to pay the amount of Daman i.e. Rs. 30,000/- within four months, in default whereof, the law shall take its own course. As regards the payment of Arsh, pursuant to Section 337-X, PPC, the petitioner is directed to pay Arsh amount of Rs. 337895/- in thirty six equal monthly installments at the rate of Rs. 9385/- per month; payable on 5th of every month till payment of above said whole amount of Arsh. First installment will be paid on 05th of November, 2024 and later shall follow accordingly.
