گرفتاری کے بعد ضمانت-ممنوعہ شق-- بار بار گولیاں چلا کر قتل عام کرنے کی کوشش کی سزا-زخمی ، طبی شواہد کے ساتھ ساتھ زخمی پی ڈبلیو کے بیانات کے ساتھ-خالی گولیاں کو جائے وقوع سے برآمد کیا گیا اور تفتیش کے دوران کالاشنکوف کو واقعہ کے دوران استعمال کیا گیا درخواست گزار سے پتہ چلا-درخواست گزار کو تفتیش کے دوران جرم میں ملوث پایا گیا ہے-درخواست گزار کے پاس یکساں مقدمات کی جرائم کی تاریخ ہے - فی الحال ، پہلی نظر میں ، درخواست گزار کو مبینہ جرم سے جوڑنے کے لیے کافی مجرمانہ مواد موجود ہے ۔ - سیکشن 324 ، پی پی سی کے تحت مبینہ جرم سیکشن 497 (1)ضابطہ فوجداری--- ضمانت کے پابند علاقے کے دائرے میں آتا ہے.

Order

Yasir Abbas (Yasir), petitioner seeks post arrest bail in a case registered vide FIR No. 715, dated 01.10.2024, offence under Sections 324, 367, 337F(iii), 337F(i), 148, 149, 34, PPC with Police Station Gojra, District Mandi Baha-ud-Din.

2.       The specific blame against the petitioner is that he armed with Kalashnikov made fire short on Muhammad Atif, brother of complainant, to take his life, which landed on the knee of his left leg. He repeated the fire shot which hit on the left elbow of the same injured.

3.       Learned counsel for the petitioner submits that damage caused by said fire shots are punishable under Section 337F(i) and 337F(iii), PPC and both the said offences do not fall within the restrictive area of Section 497, Cr.P.C.

4.       Conversely, learned Prosecutor assisted by learned counsel for the complainant, has opposed the bail application maintaining that as petitioner pressed trigger, Section 324, PPC is attracted. The petitioner has repeated the fire shot and luckily serious damage was not caused to the injured. With vehemence adds that petitioner has long crime history even of identical nature i.e. murderous assault. In order to supplement his last contention, he referred to the history of the petitioner qua criminal cases.

5.       Hearkened and record perused.

6.       The tentative perusal of record would reflect that the petitioner having been nominated in the promptly lodged crime report with the culpability of attempt to commit qatl-i-amad by making repeated fire shots with Kalashnikov on Muhammad Atif, injured, duly supported by medical evidence coupled with the statement of injured PWs. The empties were recovered from the spot and during course of investigation Kalashnikov used during the occurrence was elicited from petitioner. Petitioner has been found involved in the commission of offence during the course of investigation. Moreover, the petitioner has crime history of alike cases. At present, prima facie, sufficient incriminating material is there to connect the petitioner with the commission of alleged offence. The alleged offence under Section 324, PPC falls within the ambit of restrictive area of Section 497(1), Cr.P.C.

7.       For the reasons stated above, the petitioner has failed in making out the case of post arrest bail. Hence, instant petition stands dismissed. The above observations are tentative in nature and would not be taken as conclusive.
