آئین کا آرٹیکل 4 یہ کہتا ہے کہ قانون کی حفاظت اور قانون کے مطابق برتاؤ ہر شہری کا لازمی حق ہے۔ تشدد پولیس کی جانب سے غیرعدالتی قتل کا باعث بنتا ہے، جو کہ عملاً بے قصور ہونے کا تاثر دیتا ہے اور مجوزہ مجرموں کو انصاف کے کٹرنے کے لیے ایک ذریعہ سمجھا جاتا ہے۔ آئین ریاست پر یہ فرض عائد کرتا ہے کہ وہ ہر شہری کے حقِ حیات کی حفاظت کرے اور حراستی تشدد اور قتل کو روکے۔ یہ حقیقت سے انکار نہیں کہ پولیس کو کوئی بھی شخص گرفتار کرنے کا اختیار حاصل ہے جو قانون کی خلاف ورزی کرے، لیکن کسی بھی ایسی کارروائی میں آئین اور قانون کے ذریعہ فراہم کردہ مناسب عمل کو اپنائے بغیر اور اس شخص کے ساتھ غیر انسانی، ظالمانہ سلوک کرتے ہوئے اسے تشدد کا نشانہ بنانا نہ صرف ایک جرم ہے بلکہ بدسلوکی کے مترادف ہے۔
Article 4 of the Constitution provides that the protection of law and to be treated in accordance with law is the inalienable right of every citizen. Torture leads to extrajudicial killings by the Police, presuming de facto impunity and as a means of bringing alleged criminal to justice. The Constitution imposes a duty upon the State to protect the right to life of every citizen and to prevent custodial violence and killings. There is no denial of the fact that the police has the authority to arrest any person who violates the law, but any such action without adopting the due process provided by the Constitution and law, and treating such person inhumanly, cruelly and subjecting that person to torture, constitutes not only a criminal act, but also amounts to a misconduct.
