دفعہ 337-ڈی پی پی سی کے تحت جرم کے اجزاء ، اس صورت میں متاثر ہوں گے اگر چوٹ کسی شخص کے تنے میں جسم کی نالی تک پھیلی ہو ۔ فوری معاملے میں ، شکایت کنندہ کو صرف ایک چوٹ لگی تھی جو اس کی گردن کے پچھلے حصے پر تھی اور وہ جسم کے ٹرنک کا حصہ نہیں ہے ، لہذا ، دفعہ 337-ڈی پی پی سی کے تحت جرم کے لیے درخواست گزار کو دی گئی سزا اور سزا قانون کی نظر میں پائیدار نہیں ہے ۔ 

The ingredients of offence under section 337-D PPC, would attract if an injury extends to the body cavity in the trunk of a person. In the instant case, only one injury was sustained by complainant which was on the back side of his neck and the same is not part of the trunk of the body, therefore, the conviction and sentence awarded to the petitioner for the offence under section 337-D PPC, is not sustainable in the eyes of law.
