ویڈیو کلپ کے ساتھ گواہ کا سامنا کرنا.... دائرہ کار.... ملزموں میں سے ایک کے موبائل فون سے حاصل کردہ ویڈیو کلپ کے ساتھ تفتیشی افسر کا سامنا کرنے کی درخواست کو مسترد کر دیا گیا تھا---جواز-- گواہ کا سامنا دیگر متعلقہ دستاویزات سے کیا جا سکتا تھا جو اس گواہ کے ذریعہ تحریری یا دستخط شدہ تھے تاکہ اس کی تردید کی جا سکے ۔ تاہم ، موجودہ معاملے میں ، زیر بحث ویڈیو بنانے والے/مصنف ہونے کی بات ہی چھوڑ دیں ، گواہ مبینہ پریس کانفرنس ویڈیو میں خود بھی نظر نہیں آرہا تھا جسے دفاع گواہ کے سامنے پیش کرنے اور اس کا مقابلہ کرنے کا خواہاں تھا ۔ --اس کے علاوہ ، گواہ نے موضوع ویڈیو کے مندرجات کے بارے میں کوئی معلومات ہونے سے بھی انکار کیا تھا - - گواہ کو مبینہ طور پر دکھائی جانے والی اور اس کا سامنا کرنے والی ویڈیو کی صداقت پر نہ صرف سوال اٹھائے جا رہے تھے بلکہ ایک ملزم کے موبائل میں موجود ویڈیو کا ماخذ بھی غیر واضح رہا ۔ - اس لیے ، دو مراحل کی تصدیق وہاں نہیں تھی - - تاہم ، دفاع نے متعلقہ مرحلے پر دفاعی ثبوت داخل کرتے ہوئے اپنی عرضی کو قائم کرنے کے متبادل طریقوں کو برقرار رکھا ، اگر اسے لگتا ہے کہ زیر بحث ویڈیو اس کے معاملے کی حمایت کرتی ہے - زیر بحث ویڈیو نہ تو تحقیقات کا حصہ تھی اور نہ ہی تصدیق شدہ - ویڈیو شواہد قبولیت کے لیے ضروری قانونی تقاضوں کو پورا نہیں کرتے تھے ، کیونکہ اس کی تصدیق یا ماخذ نہیں کیا گیا تھا ، اور اس کی صداقت کی تصدیق کے لیے کوئی فارنسک رپورٹ فراہم نہیں کی گئی تھی ۔ - اس مرحلے پر ویڈیو تصادم کی اجازت دینے سے انکار درخواست گزار کے آئینی حقوق کی خلاف ورزی نہیں تھی-- -

Confronting witness with a video clip.....Scope....

Application for confronting the Investigating Officer with a video clip obtained from the mobile phone of one of the accused had been declined---Validity---Witness could be confronted with other relevant documents which were admittedly authored or signed by the said witness in order to contradict him-However, in the present case, let alone being the maker/author of the video in question, the witness was not even himself visible in the alleged press conference video which the defence was aspiring to present and confront to the witness---Moreover, the witness had also denied having any knowledge regarding the contents of the subject video---Not only the authenticity of the video purportedly to be shown and confronted to the witness was under question but also the source of the video in the mobile of one of the accused remained unclear--Thus, the two-step verification was not there---However, the defence retained alternate remedies of establishing its plea while entering in defence evidence at the relevant stage accordingly if it considered the video in question supported its case---Video under question was neither part of the investigation nor authenticated---Video evidence did not meet the necessary legal requirements for admissibility, as it was not verified or sourced, and no forensic report was provided to confirm its authenticity---Refusal to allow the video confrontation at this stage did not constitute a violation of the petitioner's constitutional rights---
