پنجاب سول سروینٹس (کارکردگی اور نظم و ضبط) رولز ، 1999 کے قاعدے 14 (2) کے تحت محکمہ جاتی کارروائی کرنے والا انکوائری آفیسر سیکشن 195 اور 476 ضابطہ فوجداری کے مقاصد کے لئے عدالت کا درجہ حاصل نہیں کرتا ہے ۔ لہذا ، سیکشن 193 پی پی سی کے تحت کسی جرم کا ادراک ۔ قانونی دائرہ اختیار کے بغیر غیر مستحکم ہے ۔

An Inquiry Officer conducting departmental proceedings under Rule 14(2) of the Punjab Civil Servants (Efficiency and Discipline) Rules, 1999, does not acquire the status of a Court for the purposes of Sections 195 and 476 Cr.P.C.; hence, cognizance of an offence under Section 193 P.P.C. without lawful jurisdiction is unsustainable.
