پارٹی کے معاملے میں ایک خامی ایک موروثی کمزوری ہے ۔ یہ ہر نگرانی یا متعلقہ مواد کو ریکارڈ پر رکھنے میں ہر ناکامی کا مترادف نہیں ہے ۔ کسی منصفانہ فیصلے کے لیے ضروری ثبوت کو محض اس وجہ سے خارج نہیں کیا جا سکتا کہ اسے کال کرنے سے غلطی کی مرمت ہو جائے گی ۔
سیکشن 94 سی آر پی سی. عدالت کو ، جب بھی وہ کسی دستاویز یا دوسری چیز کی پیش کش کو انکوائری یا مقدمے کی سماعت کے مقاصد کے لیے ضروری یا مطلوبہ سمجھتی ہے ، اسے پیش کرنے پر مجبور کرنے کے قابل بناتی ہے ۔ دفعہ 540 عدالت کو ، کسی بھی مرحلے پر ، کسی بھی شخص کو گواہ کے طور پر طلب کرنے ، موجود شخص کی جانچ پڑتال کرنے ، یا پہلے سے جانچ پڑتال کیے گئے شخص کو واپس بلانے اور دوبارہ جانچ پڑتال کرنے کا اختیار دیتی ہے ۔ اور اس کا مؤخر الذکر حصہ عدالت کو حکم دیتا ہے کہ وہ ایسا کرے جہاں ثبوت مقدمے کے منصفانہ فیصلے کے لیے ضروری معلوم ہو ۔ کیو ایس او کا آرٹیکل 161 جج کو علیحدہ طور پر متعلقہ حقائق کا مناسب ثبوت دریافت کرنے یا حاصل کرنے ، سوالات پوچھنے اور دستاویزات یا چیزوں کو پیش کرنے کا حکم دینے کا اختیار دیتا ہے ، جو اس کے شرائط میں موجود حدود کے تابع ہیں ۔ یہ دفعات آرائشی نہیں ہیں ۔ وہ نہ صرف بااختیار بناتے ہیں بلکہ جج پر سچائی کی تلاش کا فرض بھی عائد کرتے ہیں ۔
سیکشن 540 خود کنٹرول کرنے والے فرق پر مشتمل ہے ۔ اس کا پہلا حصہ جائز اور صوابدیدی ہے ؛ اس کا دوسرا حصہ لازمی ہے ۔ الفاظ "ہو سکتا ہے" اور "ہو گا" متغیر نہیں ہیں ۔ مقننہ نے مختلف تاثرات کا استعمال کرتے ہوئے دونوں حصوں میں فرق کیا تاکہ مختلف اثرات پیدا ہوں ۔ پہلے حصے کے تحت صوابدید کا استعمال عدالتی طور پر کیا جانا چاہیے ۔ دوسرے کے تحت فرض تب ہی پیدا ہوتا ہے جب عدالت ، عدالتی ذہن کی درخواست پر ، اس نتیجے پر پہنچتی ہے کہ مجوزہ ثبوت مقدمے کے منصفانہ فیصلے کے لیے ضروری ہے ۔ "ضروری" اور "منصفانہ فیصلہ" کے تاثرات خود ہی طاقت کے اندھا دھند استعمال کے خلاف تحفظات ہیں ۔
ایس ۔265 سی ۔ سی آر پی سی عدالت کو ، مقدمے کی سماعت کے آغاز سے قبل مقررہ وقت کے اندر ، ملزم کو پولیس رپورٹ ، ایف آئی آر ، سیکشن 161 اور 164 سی آر پی سیکے تحت ریکارڈ کردہ بیانات ، معائنہ نوٹ اور دیگر مواد فراہم کرنے کا پابند کرتا ہے ۔ قانون ، اس کے ایکسپریس استثناء کے تابع ۔ اس کا مقصد انکشاف کرنا ہے: ملزم کو استغاثہ کے مقدمے کا علم ہونا چاہیے اور اس کے پاس وہ مواد ہونا چاہیے جو ایک موثر دفاع تیار کرنے کے لیے قانون کو فراہم کرنے کی ضرورت ہے ۔
کسی بھی نئے طلب گواہ کی جانچ پڑتال سے پہلے ، ٹرائل کورٹ خود کو مطمئن کرے گی کہ تمام موجودہ مواد جسے قانون ظاہر کرنے کی ضرورت ہے ، درخواست گزار کو فراہم کیا گیا ہے ؛ اگر ضروری ہو تو ، تیاری کا معقول موقع فراہم کرے گا ؛ اور مکمل اور موثر جرح کو یقینی بنائے گا تاکہ آزادانہ طور پر اس ثبوت کی اندرونی قدر کا تعین کیا جا سکے ۔ اگر ثبوت کے دوران کوئی مخصوص تعصب ظاہر کیا جاتا ہے ، تو ٹرائل کورٹ قانون کے مطابق ایک مناسب حکم کے ذریعے اس سے خطاب کرے گی ۔
ابھرنے والے اصولوں کا خلاصہ مندرجہ ذیل کیا جا سکتا ہے ۔ سب سے پہلے ، پاکستانی فوجداری مقدمے کی سماعت کا عام ڈھانچہ مخالفانہ ہے ، لیکن عدالت کے پاس سیکشن 94 اور 540 سی آر پی سی. کے تحت انکوائری کردار کے محدود قانونی اختیارات ہیں ۔ اور آرٹیکل 161 کیو ایس او ۔ دوسرا ، دفعہ 540 کا پہلا حصہ صوابدیدی ہے ، جبکہ اس کا دوسرا حصہ صرف اس صورت میں لازمی ہو جاتا ہے جب ثبوت مقدمے کے منصفانہ فیصلے کے لیے ضروری معلوم ہو ۔ تیسرا ، گواہوں کے کیلنڈر سے نہ تو چھوٹ اور نہ ہی دفعہ 161 کے تحت پیشگی بیان کی عدم موجودگی ، بذات خود ، دفعہ 540 کے تحت جانچ کے لیے ایک مطلق رکاوٹ ہے ۔ چوتھا ، دفعہ 265-سی موجودہ مواد کی بروقت فراہمی کا مطالبہ کرتی ہے جسے قانون قابل انکشاف بناتا ہے ؛ اس میں کبھی ریکارڈ نہ کیے گئے بیان کو پیش کرنے کی ضرورت نہیں ہے ۔ پانچواں ، عدالت کو دفعہ 540 کا استعمال محض کسی فریق کے مقدمے کو مضبوط کرنے یا ایک موروثی ثبوت کی کمی کو دور کرنے کے لیے نہیں کرنا چاہیے ۔ چھٹا ، جب بھی اضافی ثبوت موصول ہوتا ہے ، تو ملزم کو انکشاف ، تیاری اور جرح کے ذریعے غیر منصفانہ حیرت سے بچایا جانا چاہیے ۔ ساتواں ، کسی بھی بے ضابطگی کا علاج حقیقی تعصب پر منحصر ہے ؛ ڈی نووو ٹرائل سیکشن 540 کی ہر وسط ٹرائل مشق کا خودکار نتیجہ نہیں ہے ۔
اس حکم سے علیحدگی اختیار کرنے سے پہلے ، ہم اس بات کا اعادہ کرنا ضروری سمجھتے ہیں کہ فوجداری عدالت نہ تو خاموش تماشائی ہے اور نہ ہی متبادل پراسیکیوٹر ۔ اس کا فرض ریاست کی طرف سے لائے گئے الزام پر غیر جانبدارانہ طور پر فیصلہ سنانا ہے ، جبکہ جہاں ضروری ہو وہاں قانون کے ذریعہ دیئے گئے اختیارات کا استعمال کرتے ہوئے اس بات کو یقینی بنانا ہے کہ فیصلہ انصاف کے لیے ضروری مواد پر پہنچے ۔ مقابلہ فریقین کا ہے ؛ جرم ثابت کرنے کا بوجھ استغاثہ پر رہتا ہے ؛ لیکن قانونی اور منصفانہ فیصلے کی ذمہ داری عدالت کے پاس رہتی ہے ۔
A lacuna is an inherent weakness in a party’s case. It is not synonymous with every oversight or every failure to place relevant material on the record. Evidence essential to a just decision cannot be excluded merely because calling it will repair an omission.
Section 94 Cr.P.C. enables the Court, whenever it considers the production of a document or other thing necessary or desirable for the purposes of an inquiry or trial, to compel its production. Section 540 authorises the Court, at any stage, to summon any person as a witness, examine a person present, or recall and re-examine a person already examined; and its latter part commands the Court to do so where the evidence appears essential to the just decision of the case. Article 161 of the QSO separately empowers the Judge, in order to discover or obtain proper proof of relevant facts, to ask questions and to order production of documents or things, subject to the limitations contained in its provisos. These provisions are not decorative. They not only empower but also impose a duty upon the Judge to seek the truth.
Section 540 itself contains the controlling distinction. Its first part is permissive and discretionary; its second part is mandatory. The words “may” and “shall” are not interchangeable. The legislature differentiated the two parts by using different expressions so as to produce different effects. The discretion under the first part must be exercised judicially. The duty under the second arises only after the Court, upon application of a judicial mind, reaches the conclusion that the proposed evidence is essential to the just decision of the case. The expressions “essential” and “just decision” are themselves safeguards against indiscriminate use of the power.
S.265C CrPC obliges the Court, within the prescribed time before commencement of trial, to supply the accused with the police report, the FIR, statements recorded under Sections 161 and 164 Cr.P.C., inspection notes and the other material identified by the statute, subject to its express exception. Its purpose is disclosure: the accused must know the prosecution case and possess the material which the law requires to be furnished in order to prepare an effective defence.
Before either newly summoned witness is examined, the trial Court shall satisfy itself that all existing material which the law requires to be disclosed has been supplied to the petitioner; shall afford a reasonable opportunity, if required, to prepare; and shall ensure full and effective cross-examination so as to independently determine the intrinsic value of this evidence. If any specific prejudice is shown during the course of evidence, the trial Court shall address it by an appropriate order in accordance with law.
The principles that emerge may be summarised as follows. First, the ordinary structure of a Pakistani criminal trial is adversarial, but the Court possesses limited statutory powers of an inquisitorial character under Sections 94 and 540 Cr.P.C. and Article 161 QSO. Second, the first part of Section 540 is discretionary, while its second part becomes mandatory only when the evidence appears essential to the just decision of the case. Third, neither omission from the calendar of witnesses nor absence of a prior statement under Section 161 is, by itself, an absolute bar to examination under Section 540. Fourth, Section 265-C requires timely supply of existing material which the law makes disclosable; it does not require production of a statement never recorded. Fifth, the Court must not use Section 540 merely to strengthen a party’s case or to cure an inherent evidentiary deficiency. Sixth, whenever additional evidence is received, the accused must be protected against unfair surprise through disclosure, preparation and cross-examination. Seventh, the remedy for any irregularity depends upon actual prejudice; a de novo trial is not the automatic consequence of every mid-trial exercise of Section 540.
Before parting with this order, we deem it necessary to reiterate that the criminal Court is neither a silent spectator nor a substitute prosecutor. Its duty is to adjudicate impartially upon the charge brought by the State, while using the powers conferred by law where necessary to ensure that the decision is reached upon the material essential for justice. The contest belongs to the parties; the burden of proving guilt remains upon the prosecution; but the responsibility for a lawful and just adjudication remains with the Court.
