مرحوم کی موت کا وقت ثابت نہیں ہوا --- اثر --- مرحوم کا ڈیتھ سرٹیفکیٹ اس وقت کے بارے میں خاموش تھا جب مرحوم کو مردہ حالت میں ہسپتال لایا گیا اور جب ڈیتھ سرٹیفکیٹ جاری کیا گیا --- رپورٹِ انکوائری کے مطالعہ سے یہ انکشاف ہوا کہ کالم نمبر 3 میں، اطلاع موصول ہونے کا وقت اور تاریخ "17.10.2016 صبح 10:00 بجے" درج تھی --- استغاثہ کا مؤقف یہ تھا کہ ایف آئی آر دوپہر 2:30 بجے درج کی گئی --- اگر ایسا تھا، تو تفتیشی افسر کو معقول ثبوت کے ساتھ اس کی وضاحت کرنا ضروری تھی کہ انکوائری صبح 10:00 بجے کیسے کی گئی، ایک ایسا وقت جب ایف آئی آر موجود ہی نہیں تھی --- ایسے حالات نے وقوعہ اور موت کے اس وقت کے بارے میں شک پیدا کر دیا جیسا کہ استغاثہ نے رپورٹِ انکوائری میں دعویٰ کیا ہے --- رپورٹِ انکوائری کے کالم نمبر 3 میں موت کی اطلاع موصول ہونے کا وقت اور تاریخ تفتیشی افسر نے صبح 10:00 بجے درج کی تھی، جبکہ استغاثہ کے مطابق مرحوم کو صبح 10:00 بجے چوٹیں آئیں، جبکہ واقعہ کی اطلاع مرحوم کی موت کے بعد 17.10.2016 کو دوپہر 2:20 بجے ہسپتال میں دی گئی --- مذکورہ حقیقت نے واقعہ کے وقت اور مرحوم کی موت کے وقت کے بارے میں شک پیدا کیا۔

Time of death of deceased not proved---Effect---Death certificate of deceased was silent about the time when deceased was brought in expired condition in the Hospital and when death certificate was issued---On perusal of the inquest report, it was revealed that in column No.3, the time and date of receiving information was mentioned as "17.10.2016 at 10:00 a.m.---Prosecution's version was that the FIR was lodged at 2.30 p.m.---If it was so, it was required to be explained by the Investigating Officer, by plausible evidence on record, as to how the inquest was undertaken at 10:00 a.m., a point in time when the FIR was not in existence---Such circumstance raised doubt about the time of occurrence and death as claimed by the prosecution in the inquest report---In column No. 3 of inquest report time and date of receiving information about death was mentioned as 10:00 a.m. by the Investigating Officer, whereas, as per prosecution version deceased received injuries at 10:00 a.m., whereas incident was reported after the death of deceased at 02:20 p.m. on 17.10.2016 in the Hospital---Said fact created doubt about the time of the incident and the time of death of deceased-
