 پولیس رولز ، 1934 چیپٹر 25 رولز 37 اور 39 میڈیکل آفیسر کی طرف لاش کے ساتھ جانے کے لیے پوسٹ مارٹم معائنے اور کوا فارم کے حوالے سے پولیس کے ذریعے کی جانے والی کارروائیاں فراہم کرتے ہیں ۔

پولیس کے قواعد کا مشاہدہ اور تجویز کردہ فارموں سے یہ واضح ہوتا ہے کہ پولیس کے کاغذات i.e. فارم 25.35 (1) (بی) اور 25.39 کے ساتھ دیگر تجویز کردہ رپورٹیں اور تفتیشی افسر کے ذریعہ جمع کردہ مضامین کو لاش کے ساتھ لے جانا ہے تاکہ طبی افسر کو جانچ پڑتال کے لئے تیزی سے پہنچایا جاسکے ۔ خاص طور پر قاعدہ 39 (5) میں یہ حکم دیا گیا ہے کہ لاش کے ساتھ آنے والا افسر ذاتی طور پر اسے طبی افسر کو جانچ میں مدد کے لیے تفتیشی افسر کی طرف سے بھیجی گئی تمام رپورٹس اور مضامین کے ساتھ فراہم کرے گا ۔ اگر ایسا نہیں کیا جاتا ہے اور یہاں تک کہ معقول طور پر اس کی وضاحت نہیں کی جاتی ہے ، تو یہ یقینی طور پر واقعہ کی جگہ پر کی جانے والی پولیس کارروائی کی ساکھ اور جرائم کی رپورٹ کے وقت اور مواد کے بارے میں بھی شک پیدا کرتا ہے ۔ اگر مطلوبہ رپورٹ/کاغذات لاش کے ساتھ میڈیکل آفیسر کو نہیں پہنچائے جاتے ہیں اور بعد میں یہ بھی فراہم کیا جاتا ہے کہ اس میں بھی بہت زیادہ تاخیر کے نتیجے میں دیر سے پوسٹ مارٹم ہوتا ہے ، تو اس طرح کی تاخیر کو عام طور پر ملک کی اعلی عدالتیں شکوک و شبہات کے ساتھ دیکھتی ہیں اور بار بار یہ قرار دیا گیا ہے کہ یہ عام طور پر ایسے واقعات کے معاملات میں ہوتا ہے جہاں پولیس درمیانی وقت کے دوران ابتدائی تفتیش اور استغاثہ کی کہانی کو پولیس کے کاغذات میں شامل کرنے میں مصروف رہتی ہے جیسا کہ پولیس رولز 1934 کے باب 25 کے قاعدہ 37 (1) اور 39 میں ضروری ہے ۔  

 Police Rules, 1934 Chapter 25 Rules 37 and 39 provide actions to be taken by the police with regard to postmortem examination and qua Form to accompany the dead body towards the Medical Officer.

Perusal of police rules supra and that of the forms prescribed makes it clear that the police papers i.e. Form 25.35(1)(B) and 25.39 along with other reports prescribed prepared and articles collected by the Investigation Officer are to accompany the dead body to be transported expeditiously to the Medical Officer for examination. In particular Rule 39(5) mandates that the officer accompanying the dead body shall personally deliver it to the Medical Officer along with all reports and articles sent by the Investigation Officer to assist the examination. If it is not so done and even is not explained plausibly, it surely renders doubt about the credibility of the police proceedings conducted at the place of occurrence and also about the timing and contents of the crime report. In case the requisite report/papers are not delivered to the Medical Officer with the corpse and it is subsequently provided that too with inordinate delay resulting into belated autopsy, such delay is normally seen by the superior courts of the country with suspicion and has repeatedly been held that it ordinarily occurs in cases of unwitnessed incidents where police during the intervening time remain busy in preliminary inquiry and concoction of a prosecution story to be incorporated in police papers as required in Rule 37(1) and 39 of Chapter 25 of the Police Rules, 1934.
