دفعہ 497(1) -- تعزیرات پاکستان، 1860ء (1860ء کا ایکٹ نمبر ایکس ایل وی)، 1860ء، دفعات 302 اور 34 -- بعد از گرفتاری ضمانت، مسترد ہونا -- الزام -- ایف آئی آر (ایف آئی آر) میں نامزدگی -- آتشیں اسلحے سے لیس ہو کر مشترکہ نیت سے ارتکاب -- قتلِ عمد -- عینی شاہدین نے دفعہ 161، ضابطہ فوجداری کے تحت ریکارڈ کیے گئے اپنے بیانات میں درخواست گزار کو مکمل طور پر ملوث کیا ہے -- تفتیش کے دوران، نہ صرف درخواست گزار کی نشاندہی پر مبینہ آلہ قتل برآمد ہوا، بلکہ اس کا موازنہ موقع سے برآمد شدہ خالی خول (جرائم خالی) سے کیا گیا جو کہ میچ کر گئے، اور اس حوالے سے پی ایف ایس اے (پی ایف ایس اے) کی مثبت رپورٹ بھی فائل پر موجود ہے -- درخواست گزار کا مقدمہ دفعہ 497(1)، ضابطہ فوجداری میں موجود ممانعت (ممانعت) کے دائرہ کار میں آتا ہے -- ریکارڈ پر کافی مجرمانہ مواد موجود ہے جو کہ بادی النظر میں (ابتدائی شواہد کی بنیاد پر) درخواست گزار کو مبینہ جرم کے ارتکاب سے جوڑتا ہے۔

Through this petition filed under Section 497, Cr.P.C., the petitioner seeks his post-arrest bail in case FIR No. 801/2023, dated 21.05.2023, offences under Sections 302 and 34, PPC registered with Police Station Housing Colony, District Sheikhupura.

2.       Precisely the allegation against the petitioner as per the contents of the crime report is that on 21.05.2023, at 1:30 a.m., he along with his nominated co-accused and two unknown accused persons while armed with the firearms in furtherance of their common intention committed Qatl-i-Amd of Usama Naazar brother of the complainant.

3.       Arguments heard and the record perused.

4.       It has been straightaway observed by this Court that the petitioner is well named in the crime report with the specific role of inflicting firearm injury with pistol on back of the deceased. The said injury is duly spelt out in the postmortem report of the deceased. The eye-witnesses have fully implicated the petitioner in their statements recorded under Section 161, Cr.P.C. During investigation, not only the alleged weapon of offence was recovered on the pointing out of the petitioner, rather the same was matched with the recovered crime empties, and in this respect, positive report of the PFSA is available on the file. The case of the petitioner falls within the ambit of Prohibition contained in Section 497(1), Cr.P.C. Sufficient incriminating material is available on the record; which prima facie connects the petitioner with the commission of the alleged offence.

5.       As regard the contention of learned counsel for the petitioner that co-accused, namely, Talha to whom injury to the deceased has been attributed, was granted post-arrest bail by this Court on 14.02.2024, suffice it to say that injury attributed to the said co-accused was an exit wound.

6.       Resultantly, this petition for post-arrest bail having no substance stands dismissed.
