دفعہ 498 -- تعزیرات پاکستان، 1860 (1860 کا ایکٹ نمبر 45)، دفعہ 408 -- قبل از گرفتاری ضمانت -- رقوم کا غبن -- امانت میں خیانت -- آڈٹ رپورٹ -- غیر معمولی امداد -- قبل از گرفتاری ضمانت، جس کا مقصد استثنائی اور غیر معمولی نوعیت کے مقدمات میں فراہم کی جانا ہے، اور زیادہ اہم بات یہ کہ جب ملزم کی ملوثیت بد نیتی یا عداوت پر مبنی پائی گئی ہو -- موجودہ مقدمے میں، درخواست گزار نے اپنی جھوٹی ملوثیت کے لیے کوئی بھی دشمنی، عداوت یا بد نیتی کی نشاندہی نہیں کی ہے اور چونکہ مزید تفتیش کے لیے درخواست گزار کی جسمانی حراست درکار ہے، لہذا وہ قبل از گرفتاری ضمانت کی غیر معمولی امداد کا حقدار نہیں تھا -- درخواست خارج کی گئی۔

Through this petition, petitioner seeks pre arrest bail in case FIR No. 2260/2025 dated 20.07.2025 registered under sections 408 PPC at Police Station Shadbagh, District Lahore.

2.       Arguments heard. Record perused.

3.       Perusal of the record reveals that F.I.R. was got registered on 20.07.2025 against present petitioner who while serving as an employee at the complainant’s pharmacy, allegedly misappropriated an amount of Rs. 6,00,000/-, which is well supported by audit report. During the course of investigation, the petitioner was declared guilty by the police, who is seeking extra ordinary concession of pre-arrest bail which is meant to be extended in cases of exceptional and extra ordinary nature, more importantly when the implication of an accused is found to be tainted with mala fide or malice. In the instant case no ill-will, malice or mala fide has been pointed out by the petitioner for his false implication and as the body of petitioner is required for further investigation, therefore he is not entitled to the extraordinary relief of pre-arrest bail.

4.       In view of above, instant bail petition stands dismissed and ad-interim pre-arrest bail earlier granted to the petitioner is hereby recalled and cancelled.
