یہ قانون کا ایک طے شدہ اصول ہے کہ محض تضحیک کسی ملزم کے جرم کا ثبوت نہیں ہے۔

لاش کو پوسٹ مارٹم کے لئے اسپتال منتقل کردیا گیا ہے۔ پوسٹ مارٹم 17.09.2017 کو صبح 11:45 بجے کیا گیا تھا، یعنی واقعہ کے 21 گھنٹے بعد، جبکہ پوسٹ مارٹم جانچ کرنے والے ڈاکٹر نے رائے دی تھی کہ موت اور پوسٹ مارٹم جانچ کے درمیان کا دورانیہ 21 گھنٹے تھا، جو حقیقت میں اوکلر اکاؤنٹ کے ذریعہ پیش کردہ استغاثہ کے کیس کو خراب کرتا ہے۔

The dead body was shifted to the hospital for a postmortem examination. The postmortem examination was conducted at 11:45 a.m. on 17.09.2017, i.e., 21 hours after the occurrence, whereas the doctor who had conducted the postmortem examination opined that the duration between death and postmortem examination was 21 hours, which fact vitiates the prosecution case set forth by the ocular account.

It is an established principle of law that mere abscission is not proof of guilt of an accused.
